Regulatory impact assessments

Under the Politique gouvernementale sur l'allègement réglementaire et administratif (Order 32-2014), available on the Ministère de l'Économie, de l'Innovation et de l’Énergie website, every government ministry and body must carry out a regulatory impact assessment in cases where a bill or regulation concerns or could affect businesses.

What are regulatory impact assessments for?

Overall, regulatory impact assessments expose issues with bills and regulations and explain the bills and their impact on businesses.

Such impacts may include:

  • costs and savings for businesses
  • additionnal advantages, benefits and disadvantages
  • assessment of the anticipated impact on employment

A regulatory impact assessment must include:

  • a description of the methods used to adapt the regulatory burden to the size of businesses (small- and medium-sized enterprises)
  • a comparative analysis of regulations with regard to Québec’s main business partners
  • a description of measures for regulatory cooperation and harmonization

This impact assessment concerns: 

  • optimizing and broadening the scope of automated enforcement, mainly by:

  • creating a system of fines for certain traffic violations detected by an automated enforcement system 

  • introducing new categories of offences that can be detected by an automated enforcement system  

  • regulating the locations where an automated enforcement system may be installed and the operation of such a system 

  • reviewing delivery timeframes for  statements of offence served under the Highway Safety Code 

  • abrogating driver or lessee identification where detection is conducted by an automated enforcement system 

  • giving carrier enforcement officers the authority to order drivers to drive their vehicle to a location not more than 15 km from the place of interception in order to safely conduct a vehicle inspection  

  • giving the government the authority to implement mandatory Class 1 training for new heavy vehicle drivers
