Monitoring the Conduct of Heavy Vehicle Owners and Operators

The SAAQ keeps a record on every owner and every operator of heavy vehicles to monitor their conduct.

New versions of the Conduct Review Policy for Heavy Vehicle Owners and Operators and the Conduct Review Policy for Heavy Vehicle Drivers came into force on February 17, 2023. The Excellence Program for Heavy Vehicle Drivers was also abolished on that date. Please refer to the page regarding the revisions that have been made to the conduct review policies for heavy vehicle owners, operators and drivers for more information.

Purpose of the conduct record

The conduct record lets us identify owners and operators of heavy vehiclesVehicle with a gross vehicle weight rating (GVWR) of 4,500 kg or more, as indicated on the compliance label. that represent a risk to road safety and the integrity of the road network.

Owners and operators covered

We keep a conduct record on every heavy vehicle owner or operator (HVOO) required to register in the register of owners and operators of heavy vehicles of the Commission des transports du Québec (CTQ), namely:

  • owners and operators of heavy vehicles registered in Québec, whether the vehicles are operated in Québec or in another Canadian jurisdiction
  • operators of heavy vehicles that are registered outside Canada but operated in Québec

The conduct record contains the following information

  • The type of registration (owner, operator or owner-operator)
  • The safety rating assigned by the CTQ
  • The good conduct category the owner or operator qualifies for under the Good Conduct Recognition Program, if applicable
  • The total number of points accumulated in each conduct area of the ongoing conduct review, as well as the number of points that must not be reached (threshold value)
  • Critical events triggering an immediate referral to the CTQ
  • Facility audit results (pass or fail)
  • The main declared activity and the size of the vehicle fleet
  • A list of mechanical defects detected during a roadside inspection or during a mechanical inspection carried out by a road vehicle inspection agent at the request of a peace officer
  • A list of any offences committed by the owner related to mandatory vehicle maintenance and the obligation to ensure that all equipment and mechanical systems are in good working order, as well as any offences related to mandatory equipment or the transportation of dangerous substances, school children or people with disabilities, and any offences committed in violation of the Act respecting owners, operators and drivers of heavy vehicles
  • A list of any offences committed by the operator or by drivers who were at the wheel of a heavy vehicle, and the associated number of points
  • “Driver” out-of-service ordersAn order temporarily prohibiting a driver from driving a heavy vehicle as a result of the driver's failure to comply with certain provisions of the Regulation respecting the hours of driving and rest of heavy vehicle drivers. and the number of associated points
  • Accidents in which a driver was involved while at the wheel of a heavy vehicle and the number of associated points
  • Events related to alcohol-impaired driving (while at the wheel of a heavy vehicle) that involved drivers whose services are used by the owner or operator

Events that occurred in Québec or another Canadian jurisdiction are entered in the record for a period of 2 years, except for events related to alcohol-impaired driving, which remain in the record for 10 years.

Obtaining a copy of your conduct record

A copy of your conduct record is provided:

  • upon request (online, in person, by email, by phone or by mail) 
  • as part of an intervention on our part

How to request a conduct record?

Resumption of services and important information

Note that it has been possible to obtain a heavy vehicle owner, operator or driver conduct record since May 23.

Important

  • To find out when a conduct record was last updated, refer to Section 2 of the record, entitled “Conduct review periods.”
  • We recommend that operators review their conduct record carefully. If they notice any significant difference when compared to the previous version, especially with regard to their vehicle fleet, they can apply to have their record adjusted using the form referred to below.

Online

HVOOs can now obtain a copy of their conduct record via SAAQclic Entreprises.

To access our online services, a business’s managers or officers must be authorized to consult records (Consulter les dossiers (120)) in clicSÉQUR.

We highly recommend that HVOOs download an updated copy of their conduct record, even if they obtained a copy relatively recently (prior to May 8), because a number of adjustments have been made in recent weeks.

Conduct records are updated whenever adjustments are made, with the updated version ready for download the following day. Conduct records are also automatically updated every 7 days.

Request made by a third party

You may authorize another person to request a copy of your record, by filling out the form entitled Authorization for the Disclosure of a Heavy Vehicle Owner or Operator Record by the Société de l'assurance automobile du Québec (PDF, 185.0 ko).

The completed form must be enclosed with the request.

HVOOs can give their attorney access to their clicSÉQUR account. Their attorney will then be able to use SAAQclic Entreprises to obtain a copy of the HVOO’s conduct record. 

Application to have a conduct record adjusted

Applications to have a conduct record adjusted must be faxed to 418 643 1896 or mailed to the address provided above. Note that you must now include with your application the form entitled Application to Have a Conduct Record Adjusted – Heavy Vehicle Owners, Operators and Drivers.
