On April 22, 2015, in file No. 200-06-000172-141, the Superior Court authorized a class action filed by Mr. Daniel Lepage against the Société de l’assurance automobile du Québec (the SAAQ), the Association des intervenants en dépendance du Québec (the AIDQ), as well as the centres intégrés universitaires de santé et de services sociaux (the “integrated university health and social services centres”) (the CIUSSS) and the centres intégrés de santé et de services sociaux (the “integrated health and social services centres”) (the CISSS) concerned by the class action on behalf of a group comprised of all the persons to whom the SAAQ has refused to issue a driver’s licence since January 27, 2011, following arrests made for operating a road vehicle while impaired that have resulted in unfavourable summary assessments or risk assessments.

On March 15, 2019, the Superior Court rendered a judgment in which the class action period has been limited to December 31, 2016, among other things.

Accordingly, the class action now concerns all the persons to whom the SAAQ has refused to issue a driver’s licence following arrests made for operating a road vehicle while impaired that have resulted in unfavourable summary assessments or risk assessments, between January 27, 2011, and December 31, 2016.

If you have received from the SAAQ, after December 31, 2016, a letter informing you that it refuses to issue a driver’s licence to you following an unfavourable summary assessment or risk assessment, you are no longer part of the class action.

Therefore, should you wish to bring an action against either the SAAQ, the AIDQ, the CIUSSS or the CISSS concerned by the class action, you must do so within the following time limits:

  • before September 13, 2022, if you have received the letter from the SAAQ informing you of its refusal to issue a driver’s licence to you on or before September 13, 2019;
  • within three (3) years of having received the letter from the SAAQ informing you of its refusal to issue a driver’s licence to you, if the date is after September 13, 2019.
